Whereas, CYPRESS CROSSINGS CHRISTIAN CHURCH (also known as "C4", "the Church") is permitting some organization, entity, company, or third party ("Entity") use of its Facilities. Through an agreement with the Entity, a minor child will be allowed to enter the Facilities. In consideration of being allowed to enter the Facilities and the Church's Premises, on behalf of my child:
1. I ACKNOWLEDGE, UNDERSTAND, AND AGREE that his/her safety is primarily my own and my child's responsibility.
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my child's use of the facilities.
3. I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE CYPRESS CROSSINGS CHRISTIAN CHURCH, its affiliates, owners, directors, agents, officers, managers, partners, members, volunteers, employees, other participants, and its attorneys ("Releasees") FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY CHILD'S ACCOUNT CAUSED, OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, INCLUDING NEGLIGENT RESCUE OPERATIONS. I FURTHER AGREE that if, despite this WAIVER AND RELEASE OF LIABILITY, I and/or my child, or anyone on my or his/her behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS SUCH RELEASEES from any litigation, expenses, attorney fees, loss, liability, damage, or cost which may be incurred as the result of such claim.
4. I, on behalf of my child, HAVE adequate health insurance and/or financial resources to cover the cost of any injuries or damages which my child may suffer due to his/her use of the facilities. I grant consent to CYPRESS CROSSINGS CHRISTIAN CHURCH to seek medical attention in the event my child is injured and l will be responsible for paying for any such care, I further understand that CYPRESS CROSSINGS CHRISTIAN CHURCH does not have any duty to supervise, monitor, or track the safety of my child while on the Church's premises.
5. I ACKOWLEDGE, UNDERSTAND, AND AGREE that in no event shall CYPRESS CROSSINGS CHRISTIAN CHURCH be liable to me, my child, or any third party for any indirect, consequential, incidental, special, or punitive damages arising from use of the facilities.
6. I ACKNOWLEDGE, UNDERSTAND, AND AGREE that if my child damages CYPRESS CROSSINGS CHRISTIAN CHURCH's property, fixtures, facilities, utilities, premises, or any other damage under the control or custody of the Church, I shall be solely responsible for immediate payment of the costs to repair and/or replace the damaged property to its original condition or to government approved standards. There shall be no limit to the amount of liability for such damaged property.
7. This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
I ACKNOWLEDGE THAT I AM AGE 18 OR OLDER, HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS FOR MYSELF AND MY MINOR CHILD BY SIGNING IT, HAVE SIGNED IT FREELY, AND I INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
